1. Introduction and Binding Effect

1.2 These Terms constitute a legally binding agreement between you (the “User”, “you” or “your”) and Brand Hire Ltd (“BrandHire”, “we”, “us” or “our”).
1.3 By accessing, browsing, or using the Website, you confirm that you have read, understood, and agree to be bound by these Terms in full.

1.5 These Terms apply to all Users of the Website, including without limitation candidates, prospective candidates, employers, prospective employers, and general visitors.
1.6 The use of the Website does not create, and shall not be construed as creating, any contract for recruitment services between you and BrandHire, and any such services shall be governed exclusively by separate written terms of business issued by BrandHire.
2. Company Information and Regulatory Status
2.1 The Website is operated by Brand Hire Ltd, a company incorporated and registered in England and Wales under company number 17165137.
2.2 The registered office of Brand Hire Ltd is 71–75 Shelton Street, Covent Garden, London, WC2H 9JQ.
2.3 BrandHire operates as a recruitment agency within the meaning of applicable United Kingdom legislation and conducts its business in accordance with all applicable statutory and regulatory requirements.
2.4 The Website constitutes an information society service for the purposes of the Electronic Commerce (EC Directive) Regulations 2002. No contract for the supply of recruitment services is concluded via the Website, and any such contract shall only arise upon the execution of separate written terms of business between BrandHire and the relevant party.
2.5 Where Users submit enquiries or information via the Website, such submissions do not constitute legally binding offers and BrandHire shall have no obligation to accept, respond to, or act upon any such submission.
3. Definitions and Interpretation
3.1 In these Terms, unless the context otherwise requires:
3.1.1 “Candidate” means any individual who submits information or registers interest in employment opportunities via the Website.
3.1.2 “Employer” means any organisation or individual seeking recruitment services or making enquiries through the Website.
3.1.3 “Content” means all text, data, information, images, graphics, logos, software, and other material available on or through the Website.
3.1.4 “User Content” means any information, data, or material submitted by a User via the Website.
3.1.5 “Services” means the functionality and informational services made available through the Website.
3.2 References to legislation shall include any amendment, extension, or re-enactment of such legislation and shall include all subordinate legislation made from time to time.

4.2 Any Introduction, Engagement, or provision of recruitment services by BrandHire shall be subject exclusively to separate written terms of business agreed between BrandHire and the relevant Employer or Candidate.
4.3 No information contained on the Website shall constitute an offer capable of acceptance, nor shall it give rise to any contractual obligation on the part of BrandHire.
4.4 Use of the Website shall not give rise to any agency, partnership, joint venture, or employment relationship between BrandHire and any User.
4.5 No User shall be entitled to rely on any Content on the Website as giving rise to any representation, warranty, or contractual commitment relating to recruitment services.
4.6 To the fullest extent permitted by law, Users acknowledge that they have not relied on any statement, representation, assurance, or warranty made or given by or on behalf of BrandHire which is not expressly set out in these Terms.
5. Website Access and Availability
5.1 BrandHire grants you a limited, non-exclusive, revocable right to access and use the Website for lawful purposes in accordance with these Terms.
5.2 BrandHire does not guarantee that the Website, or any content on it, will always be available, uninterrupted, or error-free.
5.3 BrandHire reserves the right to suspend, withdraw, discontinue, or change all or any part of the Website at any time and without notice, and shall not be liable to any User for any such suspension, withdrawal, discontinuance, or change.

7.2 You warrant that you have all necessary rights, licences, and permissions to submit such content.
7.3 You warrant that your User Content does not infringe the intellectual property rights or other rights of any third party.
7.4 You grant BrandHire a non-exclusive, royalty-free licence to use, store, process, and display such User Content for the purposes of operating the Website and providing its services.
8. Candidate Registration Terms
8.1 A Candidate may submit information via the Website for the purpose of being considered for potential employment opportunities.
8.2 By submitting such information, the Candidate warrants and represents that:
8.2.1 all information provided is true, accurate, complete, and not misleading;
8.2.2 the Candidate has the legal right to work in the United Kingdom or has accurately disclosed any applicable immigration status; and
8.2.3 the submission does not infringe the rights of any third party.
8.3 BrandHire reserves the right, at its absolute discretion, to verify any information submitted by a Candidate and to request supporting documentation.
8.4 Submission of Candidate information does not guarantee that:
8.4.1 the Candidate will be contacted;
8.4.2 the Candidate will be submitted for any role; or
8.4.3 any employment or engagement will be secured.
8.5 BrandHire shall be entitled to remove, suspend, or disregard any Candidate information where it reasonably considers that such information is inaccurate, misleading, unlawful, or otherwise inappropriate.
8.6 BrandHire shall have no obligation to progress any application or to provide reasons for any decision in relation to a Candidate.
9. Employer Enquiries
9.1 Employers may submit enquiries via the Website in relation to potential recruitment services.
9.2 By submitting an enquiry, the Employer warrants and represents that:
9.2.1 it has full authority to act on behalf of the organisation identified; and
9.2.2 all information provided is accurate, complete, and not misleading.
9.3 Submission of an enquiry does not constitute an offer, acceptance, or legally binding agreement.
9.4 BrandHire shall have no obligation to respond to, accept, or act upon any enquiry submitted via the Website.
9.5 Any provision of recruitment services shall be subject to separate written terms of business agreed between BrandHire and the Employer.
10. Intellectual Property Rights
10.1 All intellectual property rights in the Website and its Content are owned by or licensed to BrandHire.
10.2 You may use the Website for personal and informational purposes only.
10.3 You shall not reproduce, distribute, modify, or exploit any Content without prior written consent.
11. Data Protection and Privacy
11.1 BrandHire processes personal data in accordance with applicable data protection legislation, including the UK GDPR and the Data Protection Act 2018.
11.2 Depending on the nature of the interaction, BrandHire may act as a data controller in respect of personal data submitted by Candidates and Users, and may act as either a controller or processor in respect of personal data processed in connection with recruitment services.

11.4 Nothing in these Terms shall be construed as imposing any obligation on BrandHire beyond those required under applicable data protection legislation.

14.5 BrandHire makes no representation, warranty, or guarantee that any Candidate will obtain employment or that any Employer will successfully fill any vacancy through use of the Website, and BrandHire shall have no liability in respect of any hiring, employment, or engagement outcomes.
15. Online Safety and Content Moderation
15.1 BrandHire operates the Website in accordance with applicable legislation, including the Online Safety Act 2023 and the Digital Economy Act 2017.
15.2 BrandHire reserves the right, but shall not be obliged, to monitor, review, screen, remove, or restrict access to any User Content where it reasonably considers that such content:
15.2.1 is unlawful;
15.2.2 is harmful or inappropriate; or
15.2.3 may expose BrandHire or any third party to legal or regulatory risk.

17.1.3 any other liability which cannot lawfully be excluded or limited, including under the Consumer Rights Act 2015.
17.2 To the fullest extent permitted by law, and subject to clause 17.1, BrandHire shall not be liable for any loss of profits, loss of business, loss of opportunity, loss of data, or any indirect or consequential loss, whether arising in contract, tort (including negligence), or otherwise, which is not reasonably foreseeable as arising out of or in connection with the use of the Website.
17.3 Subject to clause 17.1, BrandHire’s total aggregate liability to any User arising out of or in connection with the Website shall be limited to £1,000.
17.4 Nothing in these Terms shall affect any statutory rights of a User acting as a consumer.
18. Indemnity
18.1 You agree to indemnify BrandHire against any losses, liabilities, costs, and expenses (including reasonable legal costs) incurred by BrandHire arising out of or in connection with:
18.1.1 your breach of these Terms; or
18.1.2 your submission of User Content in breach of applicable law or third-party rights,
provided that such losses are reasonably foreseeable and directly attributable to your actions.
19. Suspension and Termination
19.1 BrandHire may suspend, restrict, or terminate your access to the Website at any time, with or without notice, where it reasonably considers that:
19.1.1 you are in breach of these Terms;
